1. About Payhere
Payhere is a digital platform that allows Nigerians living abroad to pay bills (such as electricity, airtime, internet, TV, school fees, etc.) for their loved ones living in Nigeria. The services are provided by Payhere Technologies Ltd., a company registered under the laws of Nigeria.
2. Eligibility
To use Payhere, you must:
- Be at least 18 years old or the legal age of majority in your jurisdiction.
- Have the legal capacity to enter into a binding agreement.
- Provide accurate and complete personal and payment information.
3. User Account
To access our services, you must create an account by providing your name, email, phone number, and a secure password. You agree to:
- Maintain the confidentiality of your login details.
- Notify us immediately of any unauthorized use of your account.
- Be fully responsible for all activities under your account.
Payhere is not liable for any loss or damage from unauthorized access to your account due to your negligence.
4. Services Offered
You may use Payhere to:
- Pay utility bills (electricity, etc.)
- Recharge mobile phones (airtime and data)
- Subscribe to cable TV services
- Pay for other approved services
Payhere acts as a facilitator between you and the service providers in Nigeria. We are not responsible for the quality or availability of services provided by third-party providers.
5. Payment and Fees
- All payments must be made in the currency supported by the platform.
- You authorize Payhere to charge your payment method for transactions and applicable service fees.
- Service fees are disclosed prior to confirmation of each transaction and are subject to change.
All transactions are final once confirmed. Refunds will only be issued under specific conditions, such as failed or duplicated payments.
6. Foreign Exchange
When paying from outside Nigeria, transactions may involve currency conversion. Exchange rates are determined by our payment partners and may include a margin or fee. You acknowledge that exchange rates can fluctuate and agree to the rate displayed at the time of transaction.
7. Compliance and Verification
To comply with financial regulations (including Anti-Money Laundering and Know Your Customer laws), we may request:
- A valid government-issued ID
- Proof of address
- Source of funds
Failure to provide requested documents may result in account suspension or termination.
8. User Conduct
You agree not to:
- Use the platform for any illegal or fraudulent purpose.
- Violate any local, national, or international law.
- Interfere with or disrupt the platform or its networks.
- Use automated systems to access the platform (e.g., bots or scrapers).
Violation of these rules may result in account suspension or legal action.
9. Intellectual Property
All content on the Payhere platform—including logos, text, design, graphics, and software—is the intellectual property of Payhere Technologies Ltd. and is protected under applicable copyright and trademark laws. You may not copy, reproduce, or modify any part of the platform without our prior written consent.
10. Third-Party Services
Our platform may contain links or access to services provided by third-party vendors (e.g., utility companies, schools, telcos). We are not responsible for:
- The availability or accuracy of third-party services.
- Any loss or damage arising from third-party actions.
11. Limitation of Liability
To the fullest extent permitted by law:
- Payhere is not liable for any indirect, incidental, or consequential damages resulting from your use of the platform.
- We do not guarantee uninterrupted or error-free access to the platform.
- Our total liability to you in any circumstance will not exceed the amount paid by you for the transaction in question.
12. Termination
We reserve the right to suspend or terminate your access to Payhere at any time without notice, especially if:
- You breach these Terms.
- We suspect fraudulent or unlawful activity.
- Required by law or regulatory authority.
13. Updates to the Terms
We may modify these Terms from time to time. If we do, we’ll notify you by posting the revised Terms on our website or app. Your continued use of the platform after such changes constitutes your acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
